  • Getting Married and Working Remotely - Questions!

    Hi there!

I'm a British citizen and will be moving to Indonesia later this year and marrying my fianc? who is an Indonesian citizen.

    I have some concerns:

    1) I plan to arrive and use Visa on Arrival for simplicity (and cost effectiveness).. Can I get married on a VOA tourist visa or does it need to be a special visa?

    2) Once married, which visa will I be eligible for that allows me to work remotely for a UK company whilst in Indonesia? There seems to be some mixed information to suggest I cannot work whilst on a Spouse KITAS?

Thanks in advance, I'm sure I'll have more questions and look forward to hanging around here

2.a) There seems to be some mixed information to suggest I cannot work whilst on a Spouse KITAS?

    1) You can get married with any kind of visa .

    2) I think the most advantageous visa in your case is the one year Temporary Stay Visa sponsored by your (then) Indonesian spouse (VITAS C317) . This Visa will be converted into a spouse sponsored KITAS within one month after entering Indonesia (just now due to the COVID pandemic , Indonesian Visas are being issued for foreigners already in Indonesia , without the need to leave Indonesia) .

There is also a new visa called "Second Home" Visa (but not being issued yet) , but it looks more complicated (see details here : https://www.livinginindonesiaforum.o...soon-available) .

2.a) Maybe due to misunderstand . Spouse KITAS/Temporary Stay Permit may mean 2 different Permits : one being sponsored by an Indonesian spouse and the other being sponsored by a foreign spouse who holds a KITAS .

By being sponsored by an Indonesian spouse you are allowed to :
    - work informally in your spouse's small/medium business (without a "work permit") ; or
    - work formally in any big Indonesian based company (PT or PT PMA , or maybe Yayasan too) , adding a "work permit" to the spouse's sponsored KITAS (similar to any other foreigner with a Work KITAS) .

    --------------------------------------------------------

UU no.6 Year 2011 (Immigration Law) - not the official translation
    Article 61
Holders of KITAS or KITAP sponsored by Indonesian spouse (+ holders of ex-Indonesian KITAP) can work and / or do business to provide for his/her living and / or the living of his/her family.

Poster's Note : Unfortunately the Indonesian Government still did not issue a Regulation to implement this Article of the Law . The most official position that I know is a verbal information given by Manpower Department officers to a mixed marriage Indonesian Association (PERCA) , see details here : http://percaindonesia.com/catatan-so...-maret-2015/ (Married with Indonesians - allowed work situations)

Thanks for the answers, I'm still a little confused regarding the work permit to allow me to work for a foreign (UK) company whilst in Indonesia. Is this not possible on the Spouse KITAS's until it becomes a KITAP?

        3) Unfortunately the Indonesian "work permit" is only applicable to Indonesia based company .

The way I see it , your best 100% legal option would be : you should ask your present employer to make a contract with your Indonesian spouse's company , instead of having a employer/employee relationship . The easiest option is not 100% legal .

        4) The situations I showed you in post 2 above are valid for both KITAS and KITAP (when sponsored by Indonesian spouse) .
