  • How to Get Akta Nikah / Marriage Certificate?

    Hi I am an Australian living in Bali on a b211a visa getting married to my girlfriend from Sumba in Indonesia. We will get married in a church this month in Bali.
    I am just wondering how do I register the marriage to get a proper marriage certificate that is recognised in Australia? Do we have to return to Sumba and do it at the office there or can I do this in Bali? Also how do I get the akta nikah?
    Someone from the Sumba office for marriage registration said I need a KITAS to get akta nikah but I can't get a spouse KITAS without the Akta nikah? We have a child coming soon and I am concerned that without the akta nikah I won't be able to have my name on the Childs birth certificate. Can I still get my child an Indonesian passport and Australian passport if we are married but can't get it registered at this office? Do I need to get a lawyer to go the the office there with the law? ay information is greatly appreciated

    (#) It will be more difficult if her KTP/identity card is not from Bali (she will have to get many documents from Government Offices of the city listed in her KTP) .

    (1) First thing to do is to know the rules . Many Indonesians also don't know the rules and sometimes people end not marrying legally . See a complete info about marriage in the links below .

    After marrying legally , your wife (assuming she is Indonesian) will need to make her own KK/Kartu Keluarga/Family Card and update her KTP . For the KITAS probably Immigration will require you to register the marriage certificate at your Embassy .

    (2) You will get the Akta Nikah after marrying at church and registering the marriage in Kantor Catatan Sipil/Government Civil Registry . See the first link below for the required documents for marrying .

    (3) Not true .

    (4) For the eITAS or KITAS sponsored by the Indonesian spouse you need to have a legal marriage certificate (Buku Nikah for Muslims , otherwise Akta Nikah) .

    (5) For requesting dual citizenship for your child you need a legal marriage certificate too .

    (6) Usually it is not necessary . Try to (respectably) convince the officer or his/her supervisor that this is not the rule . In these 14 years in this Forum I don't remember of anybody who had to hire a lawyer for getting correct common documents in Indonesia .
    Due to the urgency , you may hire marriage agent (cheaper) , but be alerted that the agent may get you fake documents which will cause you future troubles .

      Hello thank you for taking the time to respond to my questions its greatly appreciated. If I am not able to get married before having this child how will I get a passport, Indonesian or Australian to return to Australia because I don't want to live in Indonesia with my family. It seems like the Sumba office requires other additional documents that are not required elsewhere in Indonesia such as a SKTT and KITAS from myself and other additional documents from my wife. I am concerned we will not be able to get the akta nikah as well as large keluarga which is required for the akte kelahiran with my name on the document.

          (a) I guess it is legally very difficult if you don't marry first .

          (b) Unfortunately it is not uncommon to face a situation like yours as some officers don't know the rules . One solution is to find the official rule to show to the officer(s) .

          If you give us more details of which office you are referring to (church , Kantor Catatan Sipil , ...) , maybe we can help you further .

          It may help also if the girlfriend's family know somebody with some influence/relation with the Government Office .

          Otherwise hiring an agent specialized in the subject may be also useful .
