    Default Property Purchase in Wife's name

    I am British and my wife is Indonesian. We were married in Malayisa and will apply for cattan sipil next month.

    My question is: Can we still purchase property in Indonesia and register it in my wife's name?

    Wow! That's complicated! So best for it to be out in mother in laws name or my sons name.

    What ages can a child be put on documents for property / land ownership?

    if she is an indonesian citizen yep you can is the short answer

    ur wife indonesian?yes off course it can use her name..and if u want to put ur son in the certificate i think u better meet a notary to discuss about it

    Not really (legally), if the OP didn't have a prenup prepared and registered before the wedding.

    Northernlad - the responses from ScooterIndo and 7thocean make it seem as if there are no problems. This is not so. Read the links provided by Howie and do further searches on "purchasing/buying/owning land/property" and similar here in the forum.

    There's only one answer and redsnapr is correct. If your wife wants a property under her name while being married with you, you (as a couple) must have a prenuptial agreement that states separation of assets between spouses. If you didn't do so before getting married, it would mean that by default you (as a foreigner) would own 50% of the house and this is in contradiction with another law which states that foreigners are not allowed to own properties in Indonesia (except specific types of lease holds which doesn't apply here), and this law prevails on the marriage law.

    So if you still want the house under your wife's name you need to divorce, write a prenup with an Indonesian notary, marry again and then register your marriage in Indonesia.

    In other words, no, you can't get a pre-nup ex post facto.
