    Default Any way to get a prenup if not in Indonesia?

    I know it's probably unlikely, but I was wondering if there were any way to get one? I will be marrying in Canada shortly and neither of us will be able to go to Indonesia to get 1 done.

    Any advice?

    i contacted a notary in jakarta (won't say who) and they quoted me at $2000 USD (19,000,000 IDR!!!) in order to draw up the prenup, send it to Canada to be signed and file the document with the court. i know this price is exceptionally high, but what would a fair price for something like this be?

    If you were here, a fair price would be about 1/10th that.

    For labor and standard filing fees, 1 million rupiah is the norm I see. You can find it for half that. Translations can add more, of course.

    i see. if anyone knows of any notaries willing to do this sort of thing (do the prenup from overseas), please let me know.

    As far as I know it doesn't have to be filed anywhere as long as it exists.
    As for translations - don't waste cash on them...as far as I know (again) the Indonesian court will only accept the one written in Bahasa Indonesia.
    I would say that shipping it via courier would be the expensive part. I know that it cost approx 400,000IR to ship one document to us using a courier when we were in Bangkok.
    The cost of our prenup was 1 million IR; all done and signed in the same day.
    So add the cost of shipping and a healthy incentive too and you should be able to come up with a ballpark figure...

    hmmm, i thought it needed to be filed with a court before the marriage in order to legalize the prenup.

    as far as I know it is legal as long as the notaris stamps/signs it (and get a couple of copies done at the same time). I am sure if I am wrong on this someone will chip in and set us both right... everyone I have tried to show mine to did not want it... or a copy of it... Marriage registrar in Bangkok, Indonesian embassy in Bangkok and Catatan Sipil here ...

    As far as I understand , you may register (not mandatory) the prenup at the court . A prenup from a notary is already legal , assuming it is made according the law(s) .

    UU1 - 1974 , Marriage Law, Article 29
    (1) Pada waktu atau sebelum perkawinan dilangsungkan kedua belah pihak atas persetujuan bersama dapat mengajukan perjanjian tertilis yang disahkan oleh pegawai pencatat perkawinan, setelah mana isinya berlaku juga terhadap pihak ketiga tersangkut.

    (2) The prenup cannot be valid if it breaks the boundaries of the law, religion and morality.
    (3) ...
    (4) During the marriage the prenup can not be changed, unless the both parties consent to change and the change is not detrimental to a third part.
