    Atlantis, she CAN NOT go to the Supreme Court directly. She has been sentenced to 15 years in jail. If she wants to appeal, she will have to appeal to Pengadilan Tinggi, the one and only for all Jakarta regions in Jl. Let Jend. Suprapto, Cempaka Putih through PN Jakarta Pusat.

    But IF she was set free by PN Jakarta Pusat, without any punishment for what she did, the prosecutor CAN go directly to the Supreme Court, without the need to appeal to Pengadilan Tinggi. This is what we call 'Kasasi'.

    Just like in Belanda I guess (cassatie: appeal to the highest court available as a last resort). Think it's based on the Code Napoléon.

    In a case like this (fatal accident while driving under the influence) in Belgium for instance, you would get convicted by two laws: Involuntary manslaughter which's punishment is 3 months to 2 years imprisonment and a 275 to 11.000 Euro fine. Driving drunk will get you an additional fine and driving ban.

    A farmer in Belgium who killed 4 cyclist with his tractor (he had loaded bales of straw in an irresponsible way, he knew the risks), got 10 months as conditional punishment/sentence and a fine.

    Yep, it was an interesting change of dress-code.

    Just out of interest, is there a law for driving when sleepy, please feel free to publish it here.

    You may gather, I hate people who drink and drive, there is absolutely no need or reason to do it. It is just morons who do this.

    Many of my Indonesian friends told me if she was Indonesian Chinese there would not have been a court case because the mob would have killed her on the spot. My friends told me the jilbab protected her from harm at the scene.

    There is also no law here against drink driving.

    My point is that the end result of driving while tired can be the same as driving while drunk - both are irresponsible. Yet I have noticed that people tend to exhibit more moral outrage at a drunk driver as public awareness campaigns have succeeded in making drink driving socially and morally unacceptable (which is not a bad thing - it also worked on smoking). Now lets see the same for the tired driver, distracted drivers or drivers who simply can't drive. Nearly 60,000 people are killed on Indonesian roads every year and I would imagine that the number attributed to drunk driving is minuscule. Your moral outrage may be misplaced.

    My stance on drink driving is not a moral outrage, and not just aimed at Indonesia. It is a completely stupid thing to do.

    I didn't know there was a specific law against driving while under the influence of drugs. There are laws against drug use and possession.

    I think the sentence is over the top.

    You miss my point. People do many stupid things that result in the death of others but their actions don't garner the same moral outrage as drunk driving.

    I understand your point, but to kill 9 people through stupid and totally preventable actions should not be taken lightly. Think about the area in which the incident took place, and the energy needed to cause that type of destruction. This was 100% as a result of her actions, and/or inaction's.

    What would you consider to be a fair sentence for killing 9 people.

    That would have change nothing for me.
    Put yourself behind a steering without being in state to drive (whatever the reason) is a crime on my understanding. I would not feel more or less pity on someone depending of what are the reason of what make the person in a state to not being able to drive.

    In a second though... when you are sleepy you will tend to decrease your speed... In this case, the girl was driving 90km/h OVER the speed limit. If you add the normal 40 max speed, it mean she was running at least 130km/h in the city! it's absolutely crazy and it's why the amount of people killed are high.
