  • Peraturan Pelaksanaan UU 6/2011 - Visa and Paspor RI

    Sorry guys I have been pretty busy the last three weeks and did not have much time for the forum. Nevertheless I received the information about two weeks ago: "they" have finally enacted it! I had the chance to receive a full copy but did not have the chance (nor the envy to be honest - that's a whopping 180 pages!) to study it yet. I should have some free time this next few days to do so, so stay tuned. I will update the thread by pasting here some of the articles and comment them. Then, I will open the thread for questions and answers...

    I am pretty happy that the forum is the first place officially announcing it.

    Addit: those of you who are indonesianist and want a copy of it are welcome to PM me an email address.

    The new Peraturan Pelaksanaan UU 6/2011 took force on April 16th 2013. At this exact date the following regulations are considered abrogated and not valid anymore.

    • Peraturan Pemerintah Nomor 30 Tahun 1994 tentang Tata Cara Pelaksanaan Pencegahan dan Penangkalan (Lembaran Negara Republik Indonesia Tahun 1994 Nomor 53, Tambahan Lembaran Negara Republik Indonesia Nomor 3561)
    • Peraturan Pemerintah Nomor 31 Tahun 1994 tentang Pengawasan Orang Asing dan Tindakan Keimigrasian (Lembaran Negara Republik Indonesia Tahun 1994 Nomor 54, Tambahan Lembaran Negara Republik Indonesia Nomor 3562);
    • Peraturan Pemerintah Nomor 32 Tahun 1994 tentang Visa, Izin Masuk, dan Izin Keimigrasian (Lembaran Negara Republik Indonesia Tahun 1994 Nomor 55, Tambahan Lembaran Negara Republik Indonesia Nomor 3563) sebagaimana telah beberapa kali diubah terakhir dengan Peraturan Pemerintah Nomor 38 Tahun 2005 tentang Perubahan Kedua atas Peraturan Pemerintah Nomor 32 Tahun 1994 tentang Visa, Izin Masuk, dan Izin Keimigrasian (Lembaran Negara Republik Indonesia Tahun 2005 Nomor 95, Tambahan Lembaran Negara Republik Indonesia Nomor 4541);
    • Peraturan Pemerintah Nomor 36 Tahun 1994 tentang Surat Perjalanan Republik Indonesia (Lembaran Negara Republik Indonesia Tahun 1994 Nomor 65, Tambahan Lembaran Negara Republik Indonesia Nomor 3572);
    • Keputusan Presiden Nomor 31 Tahun 1998 tentang Kemudahan bagi Wisatawan Lanjut usia Manca Negara

    This is a special message to Marcus: ditch all of the above regs, they can't be quoted anymore.

    @all users,
    If anyone tries to convince you that you have to do anything on the ground of what would be written in any of the above statute, just refuse as long as it is not conform to the new PP.

      Persyaratan dan tata cara masuk dan keluar wilayah indonesia

      The following article is one that I find pretty controversial.

      Pasal 5
      Bagi Orang Asing pemegang Izin Tinggal terbatas atau Izin Tinggal Tetap, selain harus memenuhi persyaratan sebagaimana dimaksud dalam Pasal 3 huruf b dan huruf c, juga harus memiliki Izin Masuk Kembali ke Wilayah Indonesia yang sah dan masih berlaku.

      Basically, taken as it is, it says that any foreigners holding an ITAS or an ITAP should be also the holder of an Izin Masuk kembali (exit/Re_entry permit). When it has been drafted I asked to an acquaintance who was in the loop of the writing of the law how it was interpreted. She answered that ERP would be considered mandatory to all and that it will be required at the issuance of an ITAS/ITAP. Well, it's all good but this interpretation is for the least hasty in my opinion. This particular article is included in chapter II of the regulation which concerns "PERSYARATAN DAN TATA CARA MASUK DAN KELUAR WILAYAH INDONESIA". In english, it means "Requirements and Procedure to entry and exit the territory of Indonesia". A correct interpretation to me would be that an ERP is indeed mandatory but only for those ITAS and ITAP holder who wish to exit/entry Indonesia and NOT to the one who are only residing without willing to move in and out. Yet, my contact was pretty adamant on her version of the interpretation even though she recognized the validity of my point. Well, I guess that we will have to wait that the Peraturan Menteri to come further detail it. In the meantime, let's say that it is mandatory (though keeping in mind the above point).

      On the plus side, her interpretation has quite a few advantages. We've seen in this very forum how difficult it can be for those who have troubles with their sponsor (ex- about to divorce people or people working for a dodgy employer) to get a letter from him/her to be issued the said ERP. At least if it is mandatory at the issuance of your permit, you don't have to worry that your relation with your sponsor deteriorate...

        Persyaratan Masuk dan Keluar Wilayah Indonesia bagi Anak Berkewarganegaraa

        This is about kids who are dual nationals.

        Pasal 9
        Anak berkewarganegaraan ganda yang masuk atau keluar Wilayah Indonesia harus memenuhi persyaratan:
        a. memiliki Dokumen Perjalanan yang sah dan masih berlaku;
        b. tidak termasuk dalam daftar Pencegahan atau daftar Penangkalan; dan
        c. memiliki fasilitas Keimigrasian jika menggunakan Paspor Kebangsaan.

        Pasal 10
        (1) Anak berkewarganegaraan ganda yang masuk atau keluar Wilayah Indonesia harus menggunakan paspor yang sama.
        (2) Anak berkewarganegaraan ganda yang masuk atau keluar Wilayah Indonesia dengan menggunakan Paspor Kebangsaan diperlakukan sebagai warga negara Indonesia jika memiliki fasilitas Keimigrasian.

        Pasal 11
        (1) Anak berkewarganegaraan ganda yang masuk Wilayah Indonesia dengan menggunakan Paspor Kebangsaan dibebaskan dari kewajiban memiliki Visa, Izin Tinggal, dan Izin Masuk Kembali.
        (2) Pembebasan dari kewajiban memiliki Visa, Izin Tinggal, dan Izin Masuk Kembali sebagaimana dimaksud pada ayat (1) diberikan bagi anak berkewarganegaraan ganda yang memiliki fasilitas Keimigrasian sesuai dengan ketentuan peraturan perundang-undangan.

        Nothing is really new here, but at least it clarifies the situation. Kids who are bi-national in one single regulation. Basically it says that any bi national kids should, in order to enter/exit Indonesia, possess a valid passport, not being on the detterence or dlacklisting list and be registered as dual national. Kids are also requested to enter and exit with the same passport and that they do not need any visa for Indonesia, permits or ERP. Enbtering and exiting with the same passport, as per the Elucidation of Peraturan Pelaksanaan UU 6/2011 is understood as:
        Ex: a kid exits Indonesia presenting his US (or whatever nationality) passport accompanied with his affidavit for an holliday. His parents also possess a valid Indonesian passport but do not use it. When he will be back, he will have to re-enter with the same US passport & affidavit and NOT with the Indonesian passport. Obviously since he has an affidavit, he is exempted of any visa. If he would have exited with his indonesian passport, keeping by the side his US passport & affidavit, the kid would have had to re-enter with the same indonesian passport.

        An affidavit is what is refered as "fasilitas keimigrasian" in the Peraturan Pelaksanaan.

          Penanggung Jawab Alat Angkut

          In the same chapter of requirements for exit/entry in the territory of Indonesia we have these few articles which introduce stiff responsabilities to airlines/ship companies bringing in and out passengers to/from Indonesia. Though it may appears not concerning us mere mortal it will have an indirect effect on us.

          Pasal 17
          (1) Penanggung Jawab Alat Angkut yang datang dari luar Wilayah Indonesia atau akan berangkat keluar Wilayah Indonesia diwajibkan untuk:
          a. sebelum kedatangan atau keberangkatan memberitahukan rencana kedatangan atau keberangkatan secara tertulis atau elektronik kepada Pejabat Imigrasi;
          b. menyampaikan daftar penumpang dan daftar awak Alat Angkut yang ditandatanganinya kepada Pejabat Imigrasi;
          c. memberikan tanda atau mengibarkan bendera isyarat bagi kapal laut yang datang dari luar Wilayah Indonesia dengan membawa penumpang;
          d. melarang setiap orang naik atau turun dari Alat Angkut tanpa izin Pejabat Imigrasi sebelum dan selama dilakukan pemeriksaan Keimigrasian;
          e. melarang setiap orang naik atau turun dari Alat Angkut yang telah mendapat penyelesaian Keimigrasian selama menunggu keberangkatan;
          f. membawa kembali keluar Wilayah Indonesia pada kesempatan pertama setiap Orang Asing yang tidak memenuhi persyaratan yang datang dengan Alat Angkutnya;
          g. menjamin bahwa Orang Asing yang diduga atau dicurigai akan masuk Wilayah Indonesia secara tidak sah untuk tidak turun dari Alat Angkutnya; dan
          h. menanggung segala biaya yang timbul sebagai akibat pemulangan setiap penumpang dan/atau awak Alat Angkutnya.
          (2) Penanggung Jawab Alat Angkut reguler wajib menggunakan sistem informasi pemrosesan pendahuluan data penumpang dan melakukan kerja sama dalam rangka pemberitahuan data penumpang melalui Sistem Informasi Manajemen Keimigrasian.

          Pasal 18
          (1) Kewajiban pemberitahuan rencana kedatangan Alat Angkut laut atau Alat Angkut udara bagi Penanggung Jawab Alat Angkut sebagaimana dimaksud dalam Pasal 17 ayat (1) huruf a adalah:
          a. paling lambat 6 (enam) jam sebelum Alat Angkut reguler tiba; dan
          b. paling lambat 48 (empat puluh delapan) jam sebelum Alat Angkut nonreguler tiba.
          (2) Kewajiban sebagaimana dimaksud pada ayat (1) diberitahukan kepada Kepala Kantor Imigrasi yang membawahi Tempat Pemeriksaan Imigrasi.

          Basically, it means that any operators carrying passengers in and out of Indonesia are responsable for these passengers in case of refusal of entrance and deportation. It means that if you are refused entry, Imigrasi would put you back in the next plane of the same company at their cost. Thus we should be ready to have our documents checked thoroughfully before check in. Those who were used to come in without an onward/return ticket AND not being resident and those with the remaining validity of passport was less than 6 months should be careful in the future.
          Though Imigrasi as always pushed airline companies to check the documents required the previous Immigration Act didn't give them much power to legally enforce and sanction them. Now, it is gonna be a tad different and it may well modify airlines attitude.

          Also, and this is just a minor point for forum members, the requirement for the companies to communicate at least 6 hours in advance (they are a bit ambitious with that to be honest) should help both Imigrasi and Bea dan Cukai to deal with smuggling and trafficking. 6 hours, (if it works) is more than enough for the Custom to screen the datas of airlines passengers and pick a few suspect guys out (new passports/weird or suspect travel routes...etc).

            Entry and exit refusal / Penolakan Masuk dan Keluar Wilayah Indonesia

            Here again, the legal power of Imigrasi is considerably increased in line with UU 6/2011.

            Pasal 25
            (1) Pejabat Imigrasi menolak Orang Asing untuk masuk Wilayah Indonesia dalam hal Orang Asing tersebut:
            a. namanya tercantum dalam daftar Penangkalan;
            b. tidak memiliki Dokumen Perjalanan yang sah dan masih berlaku;
            c. memiliki Dokumen Keimigrasian yang palsu;
            d. tidak memiliki Visa, kecuali yang dibebaskan dari kewajiban memiliki Visa;
            e. telah memberi keterangan yang tidak benar dalam memperoleh Visa;
            f. menderita penyakit menular yang membahayakan kesehatan umum;
            g. terlibat kejahatan internasional dan tindak pidana transnasional yang terorganisasi;
            h. termasuk dalam daftar pencarian orang untuk ditangkap dari suatu negara asing;
            i. terlibat dalam kegiatan makar terhadap Pemerintah Republik Indonesia; atau
            j. termasuk dalam jaringan praktik atau kegiatan prostitusi, perdagangan orang, dan Penyelundupan Manusia.
            (2) Orang Asing yang ditolak masuk sebagaimana dimaksud pada ayat (1) ditempatkan dalam pengawasan sementara menunggu proses pemulangan yang bersangkutan.

            For foreigners, there is no special novelty but situation which have occured in the past and were grey areas are now clarified. If you have/are:
            - not in possession of a valid passport
            - blacklisted
            - in possession of forged travel documents
            - do not have a visa while you are supposed to have one
            - given or made wrong informations or statement in order to get your visa
            - suspected of being infected of a contagious disease potentially endangering public health
            - suspected to be a member of an international crime syndicate
            - included in the wanted list for crimes of any nation
            - suspected to be involved in any rebellion against the Government of Indonesia (don't be too close to Organisasi Papua Merdeka, the Free Papua Movement)
            - suspected to be part of a prostitution, human smuggling and trafficking ring.

            .. then, don't be surprised if you are refused entrance. If you think about it a few of the above stipulations are subjectives. Better for you to look healthy or at least be ready to say that it's just a bad case of masuk angin if you don't look good.

            Pasal 27
            (1) Setiap warga negara Indonesia tidak dapat ditolak masuk Wilayah Indonesia.
            (2) Dalam hal terdapat keraguan terhadap Dokumen Perjalanan seorang warga negara Indonesia dan/atau status kewarganegaraannya, yang bersangkutan harus memberikan bukti lain yang sah dan meyakinkan yang menunjukkan bahwa yang bersangkutan adalah warga negara Indonesia.
            (3) Dalam rangka melengkapi bukti sebagaimana dimaksud pada ayat (2), yang bersangkutan dapat ditempatkan dalam Rumah Detensi Imigrasi atau Ruang Detensi Imigrasi.
            (4) Pembuktian kewarganegaraan Republik Indonesia sebagaimana dimaksud pada ayat (2) melalui pemeriksaan yang dilakukan oleh Pejabat Imigrasi.

            The above article may look normal, but in the past some indonesians have been denied access to their own native soil during the Suharto era. At least now, if you are indonesian you have a guarantee to be allowed to pulang kampung. Well you may get in trouble in your kampung if you are a pengikut ahmaddiyah, but at least you are free to choose your fate by coming back.
            This being said, if there is a doubt concerning your indonesian citizenship, you may be placed in detention in a RuDenIm while they check. Having visited a (brand new) rudenim in the past since a friend was the kepala, I can guarantee you that it doesn't look like any touristic resort. If there are any doubts concerning your passport, better for you to also carry a KTP, a copy of your KK or a copy of your akta kelahiran which are all a way to prove your indonesianity.
            This being said, those of you guys who have collected a second citizenship by the side while working abroad while maintaing a valid paspor RI should be concerned by the stipulations of this article. It has been written in part for you guys.

            Pasal 28
            (1) Pejabat Imigrasi berwenang menolak orang untuk keluar Wilayah Indonesia dalam hal orang tersebut:
            a. tidak memiliki Dokumen Perjalanan yang sah dan masih berlaku;
            b. diperlukan untuk kepentingan penyidikan atas permintaan pejabat yang berwenang; atau
            c. namanya tercantum dalam daftar Pencegahan.
            (2) Pejabat Imigrasi juga berwenang menolak Orang Asing untuk keluar Wilayah Indonesia dalam hal Orang Asing tersebut masih mempunyai kewajiban di Indonesia yang harus diselesaikan sesuai dengan ketentuan peraturan perundang-undangan.

            This article is also interesting. It concerns those who are refused exit. Foreigners who still have pending legal obligations (we may think of unpaid taxes for example) can be refused exit. A few years ago I wrote a post concerning the fact that sooner or later the tax department will be closely in touch with the immigration department. It may be the first stone paving the way. You guys have to remember that with UU 6/2011, Imigrasi have become the SuperCop in charge of all affairs concerning foreigners and they are in charge (with their colleagues of the relevant department) to make sure that our legal affairs and obligations are in correct order and all filled.

              Paspor RI

              The required document for the issuance of a Paspor RI, when applied in Indonesia for those who reside in Indonesia, are as follow:
              KTP, KK, birth certificate or marriage certificate (non muslim)/buku nikah (muslim or baptism certificate, SK from Depkumham for those who became Indonesian citizen, official documents concerning your change of name if it apllies and your old passport if one has ever been issued.

              Pasal 49
              Bagi warga negara Indonesia yang berdomisili atau berada di Wilayah Indonesia, permohonan Paspor biasa diajukan kepada Menteri atau Pejabat Imigrasi yang ditunjuk dengan mengisi aplikasi data dan melampirkan persyaratan:
              a. kartu tanda penduduk yang masih berlaku;
              b. kartu keluarga;
              c. akta kelahiran, akta perkawinan atau buku nikah, ijazah, atau surat baptis;
              d. surat pewarganegaraan Indonesia bagi Orang Asing yang memperoleh kewarganegaraan Indonesia melalui pewarganegaraan atau penyampaian pernyataan untuk memilih kewarganegaraan sesuai dengan ketentuan peraturan perundang-undangan;
              e. surat penetapan ganti nama dari pejabat yang berwenang bagi yang telah mengganti nama; dan
              f. Paspor lama bagi yang telah memiliki Paspor.

              The Peraturan Pelaksananan UU 6/2011, for the issuance of passport, visas and permits introduce a new concept which should enhance the issuance of any immigration document: a maximum delay for the issuance of said documents by Imigrasi is given. Article 53 (1) of the PP gives 4 days maximum after the interview with Imigrasi (this is the 4th and last step of the procedure) for the passport to be issued.

                  Future workers, investors and researchers will have to submit, on top of the above, the approval documents from the instances in charge (ex: nakertrans, BKPM, LIPI...etc). After verification of all documents, acceptance of them and payment of the fee, the foreigner should be issued a visa in a maximum of 4 working days.

                  For workers, investors and researchers a visa tinggal terbatas can be obtained at the TPI for a duration of maximum one month (it concerns mainly emergency cases) with the pre-approval of the instance concerned.

                  Visa Kunjungan and Visa Tinggal Terbatas will be further regulated by Ministerial regulations/Peraturan Menteri in a near future.

                    Visa refusal

                    The cases where a visa can be refused are described as follow:

                    Pasal 109
                    Pejabat Dinas Luar Negeri atau Pejabat Imigrasi dapat menolak permohonan pemberian Visa kepada Orang Asing, dalam hal:
                    a. namanya tercantum dalam daftar Penangkalan;
                    b. tidak memiliki Dokumen Perjalanan yang sah dan masih berlaku;
                    c. tidak cukup memiliki biaya hidup bagi dirinya dan/atau keluarganya selama berada di Indonesia;
                    d. tidak memiliki tiket kembali atau tiket terusan untuk melanjutkan perjalanan ke negara lain;
                    e. tidak memiliki Izin Masuk Kembali ke negara asal atau tidak memiliki Visa ke negara lain;
                    f. menderita penyakit menular, gangguan jiwa, atau hal lain yang dapat membahayakan kesehatan atau ketertiban umum;
                    g. terlibat tindak pidana transnasional yang terorganisasi atau membahayakan keutuhan wilayah Negara Kesatuan Republik Indonesia; dan/atau
                    h. termasuk dalam jaringan praktik atau kegiatan prostitusi, perdagangan orang, dan Penyelundupan Manusia.

                    It means that an atase imigrasi of a KBRI can refuse to issue a visa to people being:
                    1. blacklisted
                    2. in possession of travel documents which not valid or legal
                    3. not in possession of sufficient fund to live for the period of stay intended
                    4. not in possession of a return or onward ticket
                    5. doesn't have a re-entry permit to the country of origin or a visa to another country (if needed)
                    6. sick from an infectious disease potentially endangering public health

                      This thread is now open. If you have any questions concerning VISA or PASPOR RI regarding the new Peraturan Pelaksanaan, it is the place to ask them (or start a new thread).
                      If you have any questions regarding Immigration permit/Izin Keimigrasian, deportation/blacklisting or any other topics, a second (and possibly a third) thread will be started soon to quote and elaborate on articles refering specifically to it.

                      Any off topic posts (which would not be strictly on the topic of Visa or paspor RI) will be deleted.
                      Thanks.

                        How soon do you expect Immigration at the airports to start following these guidelines? Like return tickets for instance. My visa expires in Oct and I leave and return every 60 days. Normally do not have a return ticket in hand and have never been asked for one.

                          It will take weeks/months to be enforced. To be honest, even though it has been enacted three weeks ago, you would meet very few immigration officers who are aware of its enactment at the moment and even less who are aware of the Peraturan Pelaksanaan exact content. It will take weeks of socialization before that it is understood and applied... I don't think that many immigration officers read this forum anyway, so if they wait for their bosses to inform them, I guess that you are safe for a few months.
                          Be aware that a simple ferry ticket out of Batam would do by the way. I've done that for years when I was staying on Voa/sosbud, keeping a valid one way ferry ticket from Batu Ampar to Singapura in my wallet. The law says a return or an onward ticket and it can be a plane or a boat ticket. A valid bus ticket out from Entikong (Kalimantan) would also be legit if you could find a company operating a bus (and issuing official tickets) on this route. You see the picture?

                            Thank you. I am out next week and right back. Maybe I should have someone pick up an open date ferry ticket in Batam and send to me. September I will start to get a couple 60 day tourist visas until we complete our move and then start the SosBud process.

                              What has happened to the part about those married to Indonesian's being able to work?
                              The challenge is to be yourself in a world that is trying to make you like everyone else.
