View Full Version : Girl, 12, Flees From 60-Year-Old Husband to Attend School

Medan. Other 12-year-old girls complain about homework and exams, but a fifth-grader in Medan had to run away and sneak into school just to attend classes after her father forced her to marry a 60-year-old man.
The girl, identified as AG, reported her plight to the Medan office of the Indonesia Child Protection Commission (KPAID) on Tuesday. Accompanied by her 28-year-old sister, AG said her parents forced her to marry the man, identified as MIG, in October. Rismawati, AG’s sister, told the Jakarta Globe on Wednesday that her little sister had escaped from her husband’s house and was staying with her.
“She ran away from her husband’s house because she really wants to keep going to school,” Rismawati said.
She said AG was married by a cleric in front of their parents with a Rp 100,000 ($11) dowry. She said AG refused the marriage at first but their father beat her severely with a leather belt and punched her in the head.
Rismawati said they decided to go to KPAID after a police report they filed four months ago had no effect.
Every day, Rismawati took AG to her school and waited for her until her classes finished. She said she was worried that MIG’s employees would kidnap her sister and take her back to his house and AG would not be able to return to school.
Rismawati condemned MIG for marrying her younger sister against her will. She said MIG was only thinking about his own needs while ignoring the fact that AG was underage.
She said MIG promised her family that he would buy AG a house and a motorcycle. She said she did not know if he had fulfilled his promise.
The chairman of Pusaka Indonesia Foundation, of which KPAID is a member, promised to pursue the complaint. “We will sit with the police and discuss what has been keeping them from investigating the case thoroughly. We will find solutions together. We are good friends with the police,” Eddy Iksan said.
Hasan Basri, of Medan’s education agency, said that while he regretted that a child who was supposed to be in school was married to a much older man against her will, it was difficult to interfere because it was a private matter.
Magdalena Sitorus, a KPAID commissioner in Jakarta, said some parents felt children were their possessions.
“I think parents who do this should be punished. However, we do not have any law regarding this,” she said.
Now that it's in the newspaper, cops can't ignore it anymore. Good for her.
What does Magdalena Sitorus mean by "we do not have any law regarding this"? Any marriage involving a woman under 16 years old or a man under 19 years old must be approved by the court or a pertinent official.
I think she refers to the fact that there is no legal sanction to a parent to force a woman to marry against her will.
You are right, the law does not specify any legal sanction. I hope her case eventually leads to revision of UU Perkawinan and UU Perlindungan Anak.

Amazing. And I thought cops could always find a statute to sanction a worthy cause. How about:
1) Assault by the father on the daughter (or is corporal punishment allowed on one's own children?)
2) If the father forces his daughter into an illegal marriage, then he is accomplice to an illegal act. Technicality?

You are also right. Technically he can be prosecuted based on article 80 of Child Protection Law, but since the marriage took place a while back there's no more physical evidence that the beating took place. Forcing your daughter into marriage isn't covered by the Child Protection Law, it's covered by the toothless Marriage Law.

How pathetic. The government will allow the enforcement of laws mandating that women wear 'modest clothing', but they will not protect the basic human rights of a female child unless it becomes a public embarrassment. Kudos to the older sister for having bigger cajones than the police force there.

Yeah we wouldnt want him to seem to be rude interfering in the business of a pedophile - The mentality that prevails in this country is truely exhasperating at times.
If a man has sex with a child of 12 against her will thats called rape of a minor where i come from, and these kind of nonses would get what they deserve in prison.
It's task of the Government and DPR/HR mainly to revise UU Perkawinan where a sanction for parents who force their underage daughter to marry shall include in it. NU fatwa is not mandatory.
But a NU fatwa would go a long way to stop it from happening. Mostly because said cleric that married this unhappy couple at that point would not be able to do it or go against a fatwa. The parents are guilty, the new "husband" is guilty, the cleric is also guilty.

I read about that poor Yemeni girl in some local news portal (forgot whether it's in detik.com or vivanews.com).

I read before there's a 12-13 years old Yemeni girl also died when giving birth her baby.

it also goes to show what sick mother f**kers some of these men are. Hiding behind the primitive islamic bullshit is no excuse for the rape of children. About 99% of my family and friends are muslim and they all agree this is just sick and has f**k all to do with Islam, a "normal" muslim man would not want a 12 year old wife.
These people are nonses plain and simple and should be strung up from the nearest tree.

Some Indonesian minister of something useless, has been dismissed as they are not allowed more than one wife, he has three, his leaving remark was, "That it might be illegal in law but his religion allows it" I thought under Islam one could only have more than one wife under special circumstances, ie times of war, starvation, etc, or can you make the rules up as you please

Law and regulations everywhere are sad affairs. More often than not, unless it involves big bucks or big press coverage, perpetrators do not get the punishment they deserve.
I commend the young girl and her big sister for not submitting to the lack of regulations in place.

I can't think of one that fits those criteria. There are foundations specializing in street children or disabled children or orphans, but I can't find any with your broad focus and still be hands-on.

I suggest, if not done yet, that you contact LBH-APIK (Lembaga Bantuan Hukum - Asosiasi Perempuan Indonesia untuk Keadilan). They are quite active concerning women rights and I have little doubt that they could help you to find more specific organizations.

It takes a whole village to take care of the children, its everybody's job . If you saw the same 12 year old girl heading into the street and didn't see the bus coming you would stop her, " right " whats the difference. You don't need a foundation to help a baby girl from a 60 yr old chicken hawk , all you need is one good man to stand up. As an aside, most of the "Green Card" sites are scams. Anyone can apply for the annual green card lottery at the US State Department web site listed below. It can all be done on-line. Applying is free and relatively easy.

However, its hard to ignore, some parents and families would do that to help the family's economical condition. Indramayu is a place where these kinds of practices happened quite a lot.....
