good day to every one

I have a problem and I need advice please


my wife from indonesia I'm from Egypt my wife and my child now in indonesia.

the problem is:

my child now overstay for 5 month I want them come back to egypt as fast as posible

I heard that every day delayed = $20
please advice me

When is your child born?
What immigration status does he have? Type of visa?
Where did you guys marry? Did you get the marriage registered to KUA if married in Indonesia or did you report your marriage to the Catatan Sipil if married overseas?
Are you aware that your child is entitled to get double citizenship, having an Indonesian mother?

Asking these questions is not being sneaky/overly curious... it is just that without the answer, one can not answer properly.

My child born in Egypt..
she had a visa in arraival
we married in egypt with official marraige contract but not regesterd any where just in egypt .
about indonesian citizenship for my child i do not think about it now..

Wow... it is not a simple problem.
FYI, the baby is Indonesian, as well as she is Egyptian. Under Indonesian law, if she is born after Aug 1st 2006, even if born outside Indonesia, she is automatically entitled to indonesian citizenship! It means that:
1. You could have done very easily a Paspor RI at the indonesian embassy in Cairo and avoid all the fuss of having her entering with a Visa on Arrival and later overstaying.
2. You have now I think two solutions: either processing an Indonesian passport for her, but you may need a few administrative papers (egyptian birth certificte, letter reporting the declration of birth at the indonesian embassy...etc) that you may not have and go through loads of adminitrative hassles.
3. You can choose to "negociate" her overstay, but you have to do it very fast and get her out of Indonesia in the next few days if you don't want to aggravate the situation. Under Indonesian law, an overstay is punishable by a fine of IDR 200.000/day of overstaying, with a maximum of IDR 25.000.000 and/or by a jail term of a maximum of 5 years (If I remenber well). In this particular case, the mother could be prosecuted, fined and jailed. It isn't a minor offense. In reality, most of the case are settled with "negociation" with immigration officer at the airport.

In the future, I would advice you to request an Indonesian passport for the baby. However you will have to deal with a couple of problems:
- Deal with the late report of the birth at the Indonesian embassy in Cairo
- Get translated in Indonesian the egyptian birth certificate
- Deal with the late report of your marriage at the Indonesian embassy in Cairo (optionnal)

it means that for now my wife could "negociate" with immegration officer in the airport ? is it garanteed or she negociate this case with officers in the main office??

I would advise her to get in touch with the "kepala sub-seksi Lintas Batas" of her Kantor Imigrasi. Better to do it quickly to avoid to be in further troubles. Negociating at the airport, with a baby and a plane ready to take off may be a bit unconfortable.
Be aware that they won't settle it with only a couple of packs of cigarettes. It may well cost a few millions rupiah.:(

Wow....How come your wife and kid stayed so long in Indonesia when the visa on arrival only valid for 30 days...OMG.. and where were you all this time, are you with them right now?..what was she thinking?..

What is incredible is that the kid is indeed Indonesian, by birth, but entered in Indonesia with an Egyptian passport, meaning that now she is illegally overstaying in her own country... :eek:

I hope you sort out this problem soon as it sounds like a bit of a mess.

I had a problem with my visa in China last year. I got a friend to call immigration without giving any details about me, so at least I knew what I was up against when I went to immigration in person.

They won't answer over the phone to this sort of question here... You are even very lucky if anyone answer the call. The mother (and incidentally the kid also) being Indonesian, they won't put her in serious trouble. If she would have been foreigner, with money to be quickly grabbed, it would have been different.

but i'm soooo bussy her and i did not know my wife let such thing happend but I think she was sooo busy with her ill mother :rolleyes:

You know in egypt if you have a forign wife there is nothing named overstay.. but I think in indonesia they will undersatand the situation andhelp her they are good.....:o

I think in Indonesia if you go directly it will be more helpfull...I think in indonesia they love to help you find it naturally ana if it coast you pay with plessure because of this nture :)
