Hi All,
I am new to the forum, so be gentle with me, but I do have a question. I have lived in Jakarta previously, got married, bought a house etc.... We are now in a position where I have a job, that will pay for the housing. I am intending to set up a Lease contract with my company, that will allow me to rent my own house. I would be interested to know if anyone has done this, and whether the opinion is that it is legally wrong to do this.

Any response and possible typical documents would be greatly appreciated.

I do not know the legalities of taking that route, maybe someone like Atlantis may have some insight as to what the actual law states on situations like this - I am interested to hear myself.

However,I am in the same situation as yourself when I started working for the company that I am currently working for. I could either stay in a house that the company leased on my behalf or I could receive a housing allowance. Now the housing allowance may be slightly less than the amount you would receive if you had to lease it out - but you would dodge all of the paper work and legal obligations that go with it.

Also remember that if you lease out the house you are currently staying in for a specified period of time to the company that you will work for, the company may have the right kick you out of that house into another house that they rent on your behalf so they can have someone else stay in your house. Gotta be careful about that aspect.

I don't quite understand what you are trying to tell me with quote above:confused:
I assume , in your comment above, that with an allowance, I go and do what I want, and don't have to be tied down to any deal that the company has to approve.

And your last comment, is something that I hadn't considered at all. The possibility, that they may kick me out of my own house could be interesting.

My apologies for not being clear. Basically, if the amount you receive for the Housing Allowance is very close the the amount you would receive for leasing your house, it may be worthwhile to choose the Housing Allowance instead of the Leasing due to the large amount of paperwork, administration, and contractual obligations and legalities associated with the Leasing option.

The Housing Allowance gives you more freedom about where you want to live without the Leasing headaches (that is if you have purchased the house).

I think we have some resolution to my predicament, the company now understands the arrangement, and we will put in place the correct documents to satisfy all the legalities and taxation requirements. I have initiated a contract between myself and the house owner, which will be presented to the office c/w invoice. This also gets me out of the position you proposed, in that now they can't move some-one else into the property.
