im going to marry an US citizen. he's been working here for almost 2 years, and 1,5 years on his kitas (renew every 6 months) sponsored by his workplace. we plan to stay here at least another year until finally move to the US.
The thing is the school that he's working now has some problems regarding work permit. the new law about a teacher needs to have an english degree.
anticipating the future problem, im wondering if we can transfer his kitas from work to kitas that we can get after the wedding. would it allow him to work?
since we cant apply yet for the ITAP.
under the new law ive read somewhere that a foreign husband is allowed to work, but on another articles it says that he can't. please help.... :-s

(1) Yes , he can get a KITAS sponsored by you , after the wedding .

Although the new immigration Law was already approved and it seems to give more work rights for foreigners married with Indonesians , the Indonesian Department of Manpower still need to issue a regulation to specify the details in which the work will be allowed . This regulation is supposed to be issued until May 2012 , but it is not certain .
Marcus is correct. I'm in almost the same situation as your husband, so I've been checking. Other than experts like Atlantis and Marcus, I've checked at PemDa, Immigration and DisNaKerTrans. They all say the same thing - without the new PP, we have to continue to follow the old rules for working. I live 5 hours from my KanWil, and about the same to get to DepNaKerTrans. If you live in Jakarta, you have a better chance of getting a "new" answer if you go directly to the dept. of labor and transmigration, but there's no guarantee of anything changing since they don't have a reputation of being very progressive about the rules - even with the new UU.

Also you will need to be married at least 2 years before you can be employed without work permit under the new law.

That's wrong. I am afraid you have misread the law. No offense intended.
You need to have to have two years of marriage in order to get a KITAP but both KITAS and KITAP holder are included in the scope of the article 61 UU 6/2011
Pasal 61
Pemegang Izin Tinggal terbatas sebagaimana dimaksud dalam Pasal 52 huruf e dan huruf f dan pemegang Izin Tinggal Tetap sebagaimana dimaksud dalam Pasal 54 ayat (1) huruf b dan huruf d dapat melakukan pekerjaan dan/atau usaha untuk memenuhi kebutuhan hidup dan/atau keluarganya.
Also, article 61 has never implied that we will be working without work permit.
